An Explanation of Consumer Guide to Agency

As a result of the Great Recession, the State of Ohio created the Consumer Guide to Agency Relationships and required it to be provided to all buyers and sellers upon first significant real estate discussion.

What is this document?

Every brokerage in the state has to establish that it fits a category and utilize one of the State’s Consumer Guide to Agency documents to inform new buyers of the brokerage practices. When buying you’ll usually get this document along with the buyer’s representation agreement before being allowed to see a home.

What does Parker Realty & Toby do?

Parker Realty Associates has chosen to utilize the dual agency model. This allows for an agent to work with both the buyer and the seller in a transaction.

Toby Boyce and The Exchangors LLC operates under the guidance of Parker’s Consumer Guide to Agency. However, Toby does not believe that dual agency is ethical. Hence he has chosen to not take part in that type of transaction. But what if you like one of my listings or vice versa. Since 2006, Toby has operated under the idea that a buyer or seller will become unrepresented in the transaction.

  • When working with buyers. If I have a listing appointment on a property that I think my buyer will like, I’ll get them into the property to see it before the seller lists the property. In this instance the seller would essentially be for sale by the owner and we’d work together to get their property sold but I would only represent the buyer of the property.
  • When working with sellers a call comes in from a prospective buyer. I don’t run and send them the buyer representation form; Instead, they’ll get two options. I can show them the property as an unrepresented buyer, which means that I will assist them in purchasing the property but am representing the seller the entire time. The second option is to call another agent and have them show the property to them.
